Bowling Green Man Arrested on DUI Charge Was 4 Times Legal Limit

DUI13

In Florida, DUI is considered a serious crime. It becomes more serious when you cause a car accident under the influence of alcohol. Further, you can face enhanced charges based on how drunk you are at the time of the accident. In Florida, simple DUI is when you’re driving with a BAC of .08 or greater. However, if you’re found to be driving with a BAC of .15 or higher, then you can face aggravated DUI charges. In other words, the charges you face depend on how drunk you are, whether or not there was property damage, and whether or not someone was injured or killed as a result of the DUI crash.

In a recent Florida DUI case, a driver was accused of causing an accident while his BAC was .333, more than four times the legal limit.

What happened?

A Bowling Green man is facing DUI charges after causing a car crash in Florida. According to the Walton County, Florida Sheriff’s Office, it responded to a call just after 2 p.m. to a crash involving two vehicles on Highway 30A near Hilltop Drive.

At the scene, deputies found a motor vehicle operator with serious but non-life-threatening injuries. The driver was extracted from his SUV and taken to a local hospital for treatment.

Deputies say that the operator of the second vehicle was a 39-year-old man from Bowling Green. Deputies conducted a breathalyzer test on the defendant and found that his blood alcohol level was .333 which is four times the legal limit of .08 and twice the limit of .15, the threshold for an aggravated DUI charge. The defendant was charged with aggravated DUI and DUI causing property damage.

DUI causing property damage in Florida

You can face enhanced penalties if you cause property damage while operating a motor vehicle under the influence of alcohol. DUI causing property damage is considered a first-degree misdemeanor in Florida. Penalties include:

  • Up to one year in jail
  • A fine of up to $1,000
  • Driver’s license revocation for at least 6 months
  • Vehicle impoundment
  • Community service hours
  • DUI substance abuse course
  • Evaluation for substance abuse treatment
  • Costs related to the property damage caused by the accident

Penalties can be enhanced if you have a BAC of .15 or greater or a child passenger in the vehicle under the age of 18.

Ultimately, this defendant will face enhanced penalties for his BAC being more than 4 times the legal limit and causing property damage to another vehicle while under the influence of alcohol.
