If you’re in parking lot properly parked, sleeping in the car with the car running, even with the car not running, under Florida law you can still be charged and arrested for DUI. If you’re pulled over on the side of the road and the car’s not running, you can still be arrested for DUI in the state of Florida. So if you’re in the vehicle with the keys, you can be arrested for DUI in the state of Florida no matter where your vehicle is.
