Just because you’ve been in an accident after you’ve been drinking, doesn’t make you guilty of DUI. The field sobriety exercises and the observations that the officer makes, sometimes it’s difficult to determine whether or not those observations are caused by alcohol consumption or the effects of having been into an accident. You see a lot of cases where an accident’s involved and law enforcement and the cops don’t even bother getting the person checked out. So it’s difficult for them to be able to say for a certainty whether or not the stumbling or the lack of coordination that they see is from alcohol consumption or having been involved in an accident. And, it’s your attorney’s job to point out those deficiencies in the investigation to get you the best outcome possible.
