There are going to be many defenses available in any DUI case. DUI cases are typically extremely subjective, meaning that it’s the officer’s opinion as to what they’re seeing. So when they say that they hear slurred speech, when they say they see someone swaying, there’s going to be hopefully video of that to show that you weren’t doing those things. When it comes to the driving, was there any erratic driving? The field sobriety exercises, were you tired? Were you sick? Were you injured? And then when it comes to the breath test, was it properly maintained? Were you properly observed? There’s steps and procedures that law enforcement have to do in any DUI case, and if they don’t do things properly that leads to many defenses that are available for us in your case.
