Transcript:
The police have to read you your DUI rights in the state of Florida when it comes to DUI case in two instances. If there’s a crash involved, then law enforcement is required to do the crash investigation first to investigate how the crash happened, and then after the crash investigation if they are beginning a DUI investigation, then they have to read you your Miranda rights in order to begin the DUI investigation and in order to use any statements against you. If there’s not a crash involved, then Miranda is not required until after you’re arrested. If you’re arrested for a DUI that doesn’t involve a crash, if the cops ask you any questions after you’re arrested that involve have you been drinking, how much have you had to drink, things like that, then Miranda rights are required.
